Most medical malpractice and nursing home malpractice claims must first be presented under the Medical Malpractice Act 40:1299.41 which provides special protection for the health care providers who are members of the Louisiana Patients Compensation Fund. This Act requires submission and a decision or "opinion" of the panelist of your claim. It is not definitive of the merits of your claim.
